The following terms of use are authoritative for the use of the entire ViMuseo website and all content, services and products made available on or via the website.

The Terms of Use regulate the services provided by Muceums GmbH (hereinafter referred to as "ViMuseo") to business users (museums or other cultural institutions, tourism organisations, travel providers) - hereinafter referred to as "companies" - and private users of the platform - hereinafter referred to as "users" - in the version valid at the time the contract is concluded.

Please read these terms of use carefully before using our service.

Service from ViMuseo:

ViMuseo offers the companies opportunity to advertise the companies or the institution in a free basic entry via a content management system (hereinafter referred to as "CMS"). In addition, the museum is offered the opportunity to operate a shop via ViMuseo ((see terms and conditions). Users can find information about companies, exhibitions and other offers at ViMuseo.

Conclusion of the contract

1. The person responsible for the company and the user must be 18 years of age or older. Users under the age of 18 who are at least 13 years may only use ViMuseo under an account created by a parent or guardian. For this he needs his consent. Children under 13 years may not use ViMuseo. Customer and user carry the responsibility for all activities that minors do under his account.
2. The person responsible for the company hereby warrants that he/she is authorized to act on behalf of the company or institution.
3. A contractual relationship comes about by the following possibilities:
   1. The company registers via the registration form and creates, manages and publishes its information independently.
   2. The company provides ViMuseo - without registration - with information by mail or phone.
4. For the access to the use by the user there is the following possibility:
   1. The user registers with e-mail address and password and thus gets access to all offers of ViMuseo.

Performances

1. The access to a web-based software solution for the company will be activated by ViMuseo after checking the registration data (name of the institution, URL of the website, first and last name of the contact person, address).
2. ViMuseo offers companies the possibility to publish information about its company on the platform on its website www.vimuseo.com
   
3. 1. The free basic entry for a museums includes:
      • A profile photo
      • Up to six additional pictures of the museum from outside and/or inside
      • One information text with max. 800 characters
      • Texts on opening hours, prices, guided tours, other
      • A gallery with pictures of exhibits
      • Information about exhibitions
   2. The free basic entry for a tourism organization includes:
      • An image picture
      • Infotext about the region
      • Interesting facts about the companies landscape
      • Information about events
   3. The free basic entry for a travel provider includes:
      • Info area with logo and address
      • Travel offers incl. picture, information and price range to the offer
4. ViMuseo does not guarantee that the information is complete or up-to-date.

Use of the CMS by company

1. ViMuseo provides companies with a CMS free of charge in order to constantly update and expand information related to the institution.
   The license obtained to use the Services is non-transferable and subject to the following restrictions
   1. The services may not be used, if thereby against laws is offended. (This includes municipal, state, federal and international law, copyright and image rights.)
2. The company undertakes to use the access in accordance with the contract and not to pass it on to third parties. Access data must be treated confidentially and the account created must be protected from unauthorised access.
3. The following contents and products may not be published on ViMuseo:
   • Contents infringing the rights of third parties, such as intellectual property (including copyright)
   • Contents that otherwise violate existing law
   • Contents that cannot be ethically represented (such as racist, violent, pornographic, violence glorifying contents or those that are harmful to minors or in any other way violate the welfare of decency)
   The company is liable to ViMuseo for ensuring that the contents comply with the regulations mentioned in (1)-(3). The company indemnifies ViMuseo against any claims made against ViMuseo in connection with a violation of the provisions.
4. ViMuseo reserves the right to permanently exclude the company that violates points (1)-(3) from further activities on ViMuseo.
   ViMuseo may also remove content that violates points (1)-(3) from the platform without notice.
5. The company agrees that the information and products published on ViMuseo may be used in ViMuseo's communications.
6. ViMuseo constantly updates its services, i.e. the legal provisions under which the services are offered must be changed. Material changes will be communicated to the company. Continued use will take place under the new conditions.

Liability

1. ViMuseo makes no warranty that:
   1. the Website is error-free or access is continuous or uninterrupted
   the Website is error-free or access is uninterrupted or uninterrupted the Website is uninterrupted or error-free
   2. System errors or defects are corrected immediately and completely
   3. the system is free from viruses or other harmful software
   4. the system meets the expectations of all companies/users.

Companies/user understands that he/she obtains content or services from the website at it/her own discretion and risk. ViMuseo is not responsible for the correctness and protection of copyrights, morality or legality of content.

1. The services of ViMuseo may contain links to websites or services of third parties that do not belong to ViMuseo. ViMuseo cannot control the content of these sites.
2. ViMuseo is not liable for possible claims on the part of third parties, which have arisen through the user behavior of the users. Likewise ViMuseo is released from being taken up by legal claims on the part of third parties.

Disputes

1. With other members
   Should users and companies on ViMuseo not be able to resolve disputes, ViMuseo recommends to consult a third party. ViMuseo tries to help in case of disputes, ViMuseo does not make any decisions or judge legal matters.
2. With ViMuseo
   If not all problems can be solved, the place of jurisdiction is Germany.

Termination of the contract

The account can be closed at any time in the account settings.

1. Termination by customer: After account closure, the customer's entry is reset to a minimum. (name, address, emphasis)
2. Termination by user: After account closure, some content like comments and questions will still be published on ViMuseo (but without any reference to the user).
3. Claims or claims remain valid even after account closure.
